In the Fourth Transformation government, we have made important progress with regard to labor legislation, as has not happened in the past thirty years of neoliberal governments: the increase in the minimum wage, the abolition of outsourcing, social security for domestic workers, the democratization of the selection of union leaders and the non-compulsory nature of due payments. But there is still a long way to go to improve the conditions of the working class. It is necessary to reach agreements between civil society, trade union organizations and companies to guarantee other rights such as mental health, rest and family life.
In the Senate, we have just accepted, in committees, the view on reforming the Federal Labor Code, which proposes to increase the days of leave to which a worker is entitled from 6 to 12 days during his first year of employment, with a gradual increase. Having time for leisure, family interaction and leisure has been shown to improve productivity and have positive effects on the work environment, company growth, and the company’s economy. country, in addition to making a positive impact on the tourism sector.
What is currently analyzed in the legislative branch is historical, as the issue of worker leave has not changed since the federal labor law came into force on April 1, 1970. This means that for more than 52 years, the same 6 days leave has been set for Mexican workers who have a year one in service.
Mexico is one of the countries in the world with the least number of vacations guaranteed in labor legislation, with a minimum of six days after the first year of work, and gradually increasing from the second year, unlike the rest of the countries. Latin American countries, where the average is 16 days, according to data from the Organization for Economic Co-operation and Development in Latin America.
When making a comparison with countries like Cuba, Panama or Nicaragua, which give their workers 30 days off from their first year of work, in Mexico a person has to spend 45 continuous years in the same job to achieve the same rest. days. If the comparison is with Chile, Colombia, Ecuador, Venezuela or Bolivia, countries where 15 days of vacation are guaranteed from the first working year, the Mexican would have to spend 10 continuous working years to achieve the same days off.
Unfortunately, Mexico falls on the list of countries that grant fewer vacation days, followed by countries like Brunei, Nigeria, China, Uganda, Philippines, Malaysia and Thailand, which make up the group of economies with fewer than 9 days a year. the rest.
For all these considerations, we can affirm that it is a priority to update the legal framework so that it is compatible with our social reality, since it is certainly a feature of the laws of their continuous development. As legislators of the Fourth Transformation, today we pay off a historic debt we had with the workers, by assuring them an extension of the legitimate right to rest.
